Adoption Alert: Kazakhstan

On May 17, 2010, U.S. Embassy Branch Office Almaty confirmed that the Ministry of Education of Kazakhstan has instructed Kazakhstan’s Embassy in Washington and Consulate General in New York not to accept new intercountry adoption dossiers.  The Ministry said the moratorium on new adoption cases will remain in effect until Kazakhstan implements a system that is compliant with the Hague Adoption Convention; Kazakhstan intends to put such a system in place by September 2010.  Kazakhstani officials have said the moratorium will not affect adoptions that are already in process.

The Adoption Tax Credit (ATC), which was scheduled to expire in 2010, was extended for one-year (through December 31, 2011).   The highlights of the ATC are;

  • The maximum credit was increased from $12,150 to $13,170,
  • The ATC is now retroactive to January 1, 2009.  This represents a potential increase of $1,000 for adoptive families.
  • The ATC was made refundable.  If a family has no tax liability, the IRS will refund the amount due.

The extension of the ATC through 2011, was passed as part of the health care reform bill which was signed into law by President Obama on Monday, March 22, 2010.   There was some concern that the ATC would be included in the reconciliation process, however JCICS has confirmed that it is not part of reconciliation.  This means that the ATC is law until December 31, 2011.

The Kazakhstan Program continues to run smoothly, ableit slowly. In the past month alone, four families were able to complete their adoptions and bring their beautiful and healthy children home.

We have several families who have completed their dossiers and are in the pipeline waiting for travel information.

In spite of all the changes that have taken place with this program in the last year, the average wait time to complete an adoption in Kazakhstan remains between 12 and 15 months, start to finish.

Great News! The new process as designed by the Embassy of Kazakhstan is underway! EAC has already sent several dossiers to the Attorney Reviewer to be forwarded to translation soon after.

  • After your dossier is submitted to EAC and provided that it is correct and complete, it will be sent out for processing within 48 hours. After that, it will take approximately 30 days for legal review and trasnlation before it is submitted to the Embassy of Kazakhstan. Please keep this in mind when considering the dates of your documents.
  • After the Embassy of Kazakhstan receives your dossier, you can expect your invitation to travel within approximately 2-5 months.
  • Two Trips are required; the first trip is up to five (5) weeks; then home for approximately 30 days; then the second trip is approximately 2-3 weeks in length.
